Gun Battle Lands One Man in Hospital, Convicted Felon Back in Custody
BAKERSFIELD — One man is listed in serious condition at a local hospital and one man is behind bars after a late night fight erupts in a gun battle on Sunday night.
The suspect, 22-year-old Eric Elizagoyen of Bakersfield, was arrested and booked into the Kern County Jail for attempted homicide after fleeing the scene in a vehicle before being caught just a short distance away from where he brawl took place.
Elizagoyen, a convicted felon, had just finished a three-year summary probation term for a 2010 charge of possess/manufacture/sell a dangerous weapon.
He was also convicted for assault in 2009.
According to Bakersfield Police investigators, the firearm Elizagoyen allegedly used was recovered inside his vehicle.
The incident took place on June 16, at about 11 p.m., in the parking lot of the Lucky 7 convenience store off Planz and Stine road in southwest Bakersfield.
Upon arriving to a call of a fight and multiple shots fired, officers discovered that an adult victim had been shot during a disturbance and was down in the parking lot suffering from a major gunshot wound.
“Multiple men are being questioned,” said Sgt. Will McNeal. “And at least one man sustained major injuries during the shooting.”
McNeal also said that so far it does appear that all involved parties in the shooting incident are accounted for and are waiting questioning by investigators.
