Gun store burglars were arrested once before

SAN JOSE – Two brothers and a woman, who were arrested on July 24th for burglarizing a gun store/shooting range, had a prior run in with the law when the trio were arrested for burglarizing an apartment storage area.

28-year-old Jorel Lee Moreno, 26-year-old Marcus Moreno, and 39-year-old Tina Marie Guzman were arrested for the burglary of  Reed’s Indoor Range, and were noted for throwing the stolen weapons out of the windows of the car as they tried to escape.  But their recent brush with the law happened just over two weeks prior.

On July 7, 2013 a burglary and vandalism were reported at 350 E. Mission Street in San Jose, when a resident at the apartment complex saw three individuals sitting in the driveway of the complex, and believed that they did not live there.The female suspect had stayed in the vehicle while the two male suspects, later identified as Jorel and Marcus Moreno, had exited the vehicle in order to load up the car with stolen items taken from a locked storage area.

The San Jose Police were alerted to the possible theft and stopped the suspects approximately 300 feet from the scene as they were trying to leave the area.One witness identified the three suspects as the ones she had seen taking items from the storage area.Another witness at the scene was able to identify items found in the suspect’s vehicle.Several items in their possession included a Nintendo 64, a Play Station gaming system, Clerks, Fathom, and Legend dolls, along with movie boxes and trading cards also found among the items.The owner of the property estimated the value to be $1000.00. The stolen items were photographed and returned to the owners.

The reporting person at the scene was able to give officers a description of the vehicle that was identified as a dark colored SUV with a missing front bumper.When officers arrived there were several opened plastic bins placed on the ground near the gated entranceway in the driveway. In order to enter the premises you need access to the electronic gate or door.Near the storage area, a broken window was located next to an area where several locks had been broken, apparently in order to look for items.

The investigating officer at the scene questioned the front passenger, Marcus Moreno, who was asked what he was doing with all the items in the car.Marcus told the officer “His cousin had told him that a friend was moving out so he could come by and pick up the extra items that his friend could not take with him.”

Marcus had claimed that his cousin drove away before they loaded up and was not able to identify the friend.He told the officer that they never went into the garage or storage area to get the items.

The driver Tina Marie Guzman told them “Marcus had asked her to drive her to an apartment complex to get some things from someone that was moving.”She said she watched them exit and move behind the closed gate.Neighbors near the scene reported to officers that the facility was burglarized less than a week prior but could not identify who was responsible.

All three suspects were booked into the Santa Clara Main Jail on July 7th on charges of First Degree Burglary under 459-460 (a), and for the crime of Vandalism under PC 594(a). Apparently free on bail, the three were once again caught by police fleeing the scene of the gun store burglary. Guzman was the driver in both incidents.
