TEHACHAPI — Police arrested a 29-year-old man on Monday for date raping his former alleged girlfriend.
Brian Yearwood was booked at the Kern County Sheriff’s Central Receiving Facility on charges of felony rape by force or fear and one misdemeanor count of disobeying a court order or process.
He is also being held for one misdemeanor count of battery and one felony count of violating probation.
According to Tehachapi Police Chief Jeff Kermode, Yearwood was taken into custody on Dec. 9, after a 29-year-old female victim reported to police on Saturday that she was raped at a home in the 200 block of East “I” Street in downtown Tehachapi.
Yearwood and the unidentified female, supposedly had a prior dating relationship, and according to Kermode — a history of violence.
“The victim has a restraining order filed against the suspect,” Kermode said. “And she is claiming that the physical contact was against her will, and he is claiming that it was consensual.”
Kermode also added that the crime allegedly occurred at the residence of a mutual friend of the two.
Officers said that when they arrived to take Yearwood into custody, he fled the scene through a rear door at the house he was staying in, running towards an alley.
After a short foot pursuit, officers were able to convince Yearweood to stop resisting arrest, and he was taken onto custody without incident.
