SAN JOSE, Calif — The Santa Clara County Sheriff’s Department has seen the arrest of an individual who not only served as a correctional deputy at the Santa Clara County Main Jail but also worked at the Milpitas Elmwood jail facility.
According to the Santa Clara County Sheriff’s Department, 33-year-old Anthony Felix Diaz was arrested under molestation charges that he sexually assaulted a 9-year-old girl that Diaz had been in contact with for several months.
Arresting San Jose Police investigators followed up on allegations that were filed back in 2012 by the victim’s mother, who reported that during the time of the incident Diaz was living in their home on Cedar Lane in San Jose.
On May 9, 2016, suspect Diaz was arrested and booked into the Santa Clara County Jail for 288.7(b) PC — Sex act with a child under 10 years of age (felony) and two counts of 273(d) PC — Felony Child Abuse.
According to the San Jose Police Department, SAIU detectives conducted follow up investigation and determined the above listed crimes were alleged to have been committed by suspect Diaz, who is a Corrections Deputy with the Santa Clara County Sheriff’s Office. Based on the follow up investigation, detectives obtained an arrest warrant.
“The allegations are deeply disturbing. If they are true, this correctional deputy did not meet the standards of our office and he must be held following standard protocol. In addition to the criminal investigation by the San Jose Police Department, the Sheriff’s Office will conduct an internal investigation into the allegations against correctional deputy Diaz,” Sheriff Laurie Smith said.
Julio Alvarez, acting president of the Santa Clara County Correctional Peace Officers’ Association, said, “We condemn such heinous acts, if substantiated, and look to the justice system to determine guilt or innocence.”
