SANTA ANA – The Orange Country District Attorney’s Office has announced Friday’s sentencing for a man who attacked a female jogger with the intent to sexually assault her.
Mario Orlando Montano (59) of Anaheim was found guilty by a jury on June 21, 2017, of two felony counts: Assault with the intent to commit a sexual offense, as well as force likely to produce great bodily injury.
According to court records, 24-year-old Jane Doe was jogging on a trail in a reservoir in Anaheim Hills on the afternoon on December 10, 2013. When she slowed to a walk, Montano jogged up to the victim, tried to engage her in conversation, then tackled Jane Doe to the ground.
Montano climbed on top of her as she kicked and struggled to escape his grasp. When the victim began to scream, Montano covered her mouth – knocking out the victim’s tooth during the struggle.
Montano then reached for his pants with the intent to commit a sexual assault, but Jane Doe was able to kick him and escape. She ran to a nearby home and called 911. Anaheim Police Department’s immediate response located the defendant on the trail. APD investigated the case. Deputy District Attorney Harris Siddiq, Felony Panel, was Prosecutor.
The 7-year maximum state prison sentence included additional sentencing enhancements found true: ‘Great bodily injury to a sexual assault victim’ and ‘Great bodily injury.’ In addition to prison, Montano was slapped with a mandatory lifetime sex offender registration pursuant to PC 290.
