FORT BRAGG – A person on active probation is subject to random searches by law enforcement. On November 30th at 9:20 a.m., 26-year-old Luis Pineda was the focus of just such a search.
Approaching deputies noticed that Pineda kept his right hand in his pocket and would not remove it at their direction.
Since he would not obey their commands, a deputy grabbed Pineda’s hand, and a 9mm semiautomatic pistol fell to the ground. In addition, the suspect had a holster wrapped around his neck that contained a magazine with 9mm ammunition.
Finally, they also discovered a gram of meth in his possession. Further investigation revealed that the pistol was loaded and its serial number had been rubbed out.
Pineda tested positive for being under the influence of a controlled substance. He was arrested and held on a $35,000 bond.
