SAN RAFAEL — A 71-year-old man was arrested on suspicion of shooting one of his guests during a Christmas party. The suspect who is no longer in custody now faces three charges.
Festivities turned into a police matter on December 15 at 110 C Street. Someone nearby summoned police at 1:30 a.m. and reported hearing gunshots at the residence.
While police were investigating the source of gunfire, a man hobbling along the street approached them. He pointed to his bloody foot and told the officers how it happened. The victim apparently dared the suspect to shoot. And that’s when the victim was shot in his foot.
Paramedics were called and the victim was transported to a hospital to receive medical treatment. The victim and his wife were leaving the party, when he was shot.
While waiting for paramedics, officers learned an altercation preceded the shooting. A commotion erupted after a woman at the party was shoved and she fell onto a sofa.
Shortly afterward, the host allegedly pointed a gun, threatened to shoot his guest, and ordered him to leave. Moments later gunfire rang out.
The man was struck by a single bullet. His wife who was on the front porch with him was not injured. Despite his injury, the victim was still able to walk and flag down the police.
The suspect identified as 71-year-old David M. Simonini was arrested and booked into Marin County Jail. His charges are as follow:
• Assault with a firearm 243 (E) (1)
• Battery 245 (A) (2)
• Making threats of violence 422
