Kings County Sheriff’s Office deputies were called to a residence on the 700 block of East Elm
Avenue in Hanford about 12:45PM on Sunday regarding an unwanted visitor.
56-year old Charles Aguilar and 47-year old Marc Arce were in front of the home when deputies arrived.
Aguilar told deputies he was there to pick up his three-year old daughter. The residents of the home showed deputies paper work proving Aguilar didn’t have custody of his daughter; she had been removed from his care and placed in their care by Kings County Child Protective Services.
While investigating, deputies determined Aguilar and Arce to be under the influence of illegal narcotics. They also found a loaded Walther P22 semi-automatic handgun on Arce. The men were arrested for several narcotic and weapons related violations. They were booked into the Kings County Jail.
After fulfilling the 6-hour hold at the jail, Aguilar returned to the Elm residence at around 11:45PM that same day. Aguilar broke into the residence and took his daughter before driving away in his silver BMW. When the guardians noticed the little girl was missing a short time later, they called the KCSO.
The KCSO detective unit took over the case and contacted the California Highway Patrol to
issue an Endangered Missing Advisory for Aguilar and his daughter. Several law enforcement
agencies and media sources received the EMA.
Given the gravity of the situation, an exigent circumstances ping was used to locate Aguilar’s cellphone allowing detectives his location: he was traveling eastbound on Interstate 40 near Barstow, CA.
On their way to the area, CHP received a phone call from citizen reporting she saw the little girl at a rest stop.
Upon locating Aguilar’s silver BMV on Interstate 40, near Needles, CA, CHP officers initiated a traffic stop. Aguilar pulled over and was taken into custody without further incident.
The unharmed child was placed in the custody of Kings County Child Protective Services. Kings County Sheriff’s Office detectives took custody of Aguilar at the Barstow CHP Office. He was transported back to the Kings County Jail and booked for kidnapping, burglary, and child
endangerment. His bail is set at $200,000.
