“On June 10th, 2022, three assaults with a deadly weapon occurred in three separate locations in San José in the span of approximately 45 minutes. All three victims were struck by a lead pellet fired from a high-powered air rifle. The following day, another victim was struck by a pellet. In response to these incidents, the San José Police Department formed an Internal Task Force to identify and apprehend the suspect.
During the ensuing investigation, detectives discovered three additional incidents between April 14th, 2022, and June 15th, 2022, bringing the total number of incidents to seven. In all seven incidents, the victims were struck with high velocity projectiles believed to be pellets. In several of these cases, doctors declined to remove these projectiles from the victims due to the inherent risk posed by the procedure. The victims ranged in age from 9 years old to 56 years old, including a 15-year-old. Six out of the seven victims were female. Six of the shootings occurred in San Jose and one occurred in Campbell.
After an exhaustive investigation that included collaboration between the San José Police Department, the Campbell Police Department, and the Santa Clara County District Attorney’s Office, detectives developed information that implicated Nicholas Montoya as the suspect in the shootings. This information included a unique suspect vehicle description as well as evidence seized via search warrants.
On Tuesday, August 2nd, the San José Police Department’s Covert Response Unit located and apprehended Suspect Montoya at his residence in the 200 block of Beverly Court in the City of Campbell.
After collaborating with the Santa Clara County District Attorney’s Office, the suspect was booked on a warrant charging him with 7 counts of 245 PC – Assault with a Deadly Weapon, and 243D PC – Assault causing great bodily injury.
