Orange County Man Convicted of Murder in Fatal Shooting of 6-Year-Old Aiden Leos

A Costa Mesa man has been convicted of murder for the fatal road rage shooting of a 6-year-old boy.
In a press release, the Orange County District Attorney’s Office announced that Marcus Anthony Eriz, 26, had been convicted of felony second-degree murder in the May 21, 2021, shooting of Aiden Leos. Martiz was also convicted of felony shooting into an occupied vehicle, along with two felony enhancements for the personal use of a firearm causing great bodily injury or death.
The driver of the Volkswagen Sportswagen that Martiz had been riding in, identified as 26-year-old Wynne Lee, has reportedly also been charged with felony accessory after the fact and a misdemeanor count of concealing a firearm in a vehicle.
According to the District Attorney’s Office, Aiden’s mother testified at trial that, on the morning of Friday, May 21, 2021, she had flipped off the driver of the Sportswagen after the driver had cut her off in traffic along the northbound 55 freeway, near Chapman Avenue. As she drove away, she heard a “large noise” and heard Aiden say “ow.” She then pulled over, got Aiden out of his seat, and called 9-1-1.
Aiden later died of his wound at the Children’s Hospital of Orange County.
The California Highway Patrol began a manhunt for the suspect in connection with the shooting, broadcasting a description of the suspect vehicle as a 2018/2019 white Volkswagen Sportswagen and calling on the public to come forward with any relevant information. On Sunday, June 6, 2021, both Eriz and Lee were located and arrested.
Eriz’s sentencing has been scheduled for April 12, 2024. He faces a maximum of 40 years to life in prison.
Lee is currently awaiting trial and remains free on $100,000 bond, but must also under GPS monitoring. If convicted as charged, she faces a maximum of three years in state prison and one year in the Orange County Jail, the District Attorney’s Office said.
