“Sergeant Luis Lara, while patrolling the southbound lanes of State Route 99, noticed a suspicious vehicle parked on the highway’s shoulder. The driver appeared to be asleep. Due to ongoing construction, Sergeant Lara was unable to approach the vehicle directly and promptly radioed Sergeant Shane McConnell for assistance.
Upon arrival, Sergeant McConnell noticed a male adult asleep at the wheel with the vehicle’s engine running. Visible signs of potential intoxication were immediately apparent, including open beer bottles in the vehicle’s center console. Upon awakening the driver, Sergeant McConnell noted signs of impairment.
Further inspection revealed what appeared to be a large amount of marijuana in the back seat. An additional officer was called to the scene, culminating in the driver’s arrest under suspicion of driving under the influence (DUI) and possession of marijuana, in violation of sections 23152(a) and 23152(b) of the California Vehicle Code, as well as sections 11359 and 11360(a) of the California Health and Safety Code.”
