SAN RAFAEL — Police arrested a man after early morning gunfire disturbed residents in the Canal District. The incident occurred April 29 outside an apartment complex. Nardo DeLeon, 57, of San Rafael, was apparently intoxicated when he allegedly fired multiple shots.

The gunfire erupted on Canal Street. Officers responded to the reported gunfire shortly after 9 a.m. In a prepared statement San Rafael police said. “There were no injuries as a result of this isolated incident.”

An eyewitness saw a man firing shots into the ground in a parking lot. After the shooting stopped, he was seen throwing a handgun inside a parked car. He got inside the car and evidently passed out soon thereafter.

The Marin County Sheriff’s Office dispatched an aerial drone to observe the car. Meanwhile, police surrounded the apartment complex. Officers approached the car with armored shields for protection. They found DeLeon unresponsive sitting in the driver’s seat.

Officers attempted to get DeLeon to follow directions to no avail. They opened the car door and placed DeLeon under arrest. As he was being taken into custody DeLeon was observed to be intoxicated. He was transported and booked at Marin County Jail, but he is no longer in custody.

Evidence was gathered from the shooting scene. A handgun and 14 bullet casings were recovered. Detectives obtained phone video recorded by a witness. It shows DeLeon manipulating the handgun in the parking lot.

DeLeon was arrested for the following charges –

  • Carrying a loaded firearm
  •  Discharge of a firearm in a negligent manner
  • Public intoxication
