SAN RAFAEL — A man with a criminal history is in custody for assault, burglary and
attempted kidnapping. David J. Margoliash, 48 of San Rafael, was arrested for more crimes
on November 30. Margoliash now remains at Marin County Jail ineligible for release on bond,
while awaiting sentencing for an unrelated conviction.
Margoliash was booked for assault with a deadly weapon/not a firearm, burglary, and
attempted kidnapping. Since 2016 he has been arrested 10 times. His prior arrests involved
battery, prohibited firearm possession, burglary, and possession of tear gas. He was recently
convicted for attacking the Islamic Center of Marin in Novato last March.
Last month, Margoliash allegedly broke into a San Rafael residence and attacked a pregnant
woman and her husband. After fleeing from their home, he allegedly attempted to kidnap an
elderly patient from a skilled nursing facility.
On November 30 at 1:12 a.m., a Ross Street resident reported an intruder entered his home
through a back door. Noises made by intruder woke his pregnant wife. She started screaming
when she saw the stranger inside her living room. Then he whacked her head with a
flashlight, officials said.
The expectant mother’s screams woke her husband who fought the intruder. Her husband
struggled to get him outside of the house. He pushed the intruder down a flight of patio stairs,
before the intruder fled.
At 5:18 a.m., employees at San Rafael Healthcare and Wellness Center on Fifth Avenue
reported a suspicious man. He said he wanted take a patient to Santa Rosa. The suspect
pretended he was a patient transport service employee. Employees determined the man was
lying and contacted the police.
In a prepared statement San Rafael police said. “Margoliash was positively identified as the
suspect in the residential burglary and the attempted kidnapping of a patient from the care
facility.”
