According to the Deputy District Attorney Tim McInerny, “Former professional football player Dana Stubblefield was charged today with the rape of a disabled woman.”
Gary Winuk, the leading attorney for the ex-49ers star Dana Stubblefield, filed a motion Friday calling on the Santa Clara County District Attorney to recuse himself from the rape case, stating that the charges were filed a year after the allegations and that the case had been highly publicized, leaving little room for an unbiased jury.
The information provided in the case suggests that the 45-year-old Stubblefield sexually assaulted the developmentally disabled victim after she had come to the home looking to interview for a babysitter job.
The victim told Morgan Hill Police Officers on April 9, 2015, that she had traveled to Stubblefield’s home after he contacted her through a babysitter website. When she went into the home for the interview, he allegedly began to assault her.
The 31-year-old female victim then left the home and immediately went to the Morgan Hill Police Department to report the crime.
McInerny said, “Stubblefield faces five felony counts related to the assault.” When found guilty of a rape, the suspect can expect to face a substantial prison sentence. Bail has been set at $250,000. The case is being heard in the South County Courthouse in Morgan Hill.
“This was a crime of violence against a vulnerable victim,” McInerny said. “She was looking for a job and she was unconscionably assaulted.”
