SAN JOSE — A man reportedly fired on officers after they received a 9-1-1 call of a male erratically walking through a neighborhood with a large handgun.
According to San Jose Police Officer Albert Morales, “On Sunday, May 7, 2017, at approximately 7:59 AM, San Jose officers responded to the 2200 block of Tully Road on a report of a suspicious person armed with a handgun.”
Soon after their arrival they found the suspect near the area of the call. Morales said, “Giving the suspect commands, the suspect pulled out a .45 caliber pistol and fired in the direction of the officers.” A 16-year veteran San Jose Police officer fired at the suspect before he jumped the fence, temporarily escaping into a nearby mobile home complex.
Responding officers soon quarantined the area in order to make contact with the suspect and then to bring him into custody. Morales said, “The .45 caliber handgun, which had been stolen in a 2013 burglary, was also located.”
29-year-old Kevin Riley was booked into the Santa Clara County Jail for three counts of attempted murder of a police officer and possession of a stolen firearm. The motive and circumstances surrounding the incident are still under investigation.
The officer will be placed on routine paid administrative leave. The Santa Clara County District Attorney’s Office will review the investigation upon completion of the San Jose Police Department Homicide Unit’s criminal investigation.
The case is being monitored by the San Jose Police Department’s Internal Affairs Unit, the City Attorney’s Office, and the Office of the Independent Police Auditor.
