Twin now faces accessory to murder after brother charged in fatal stabbing
SAN JOSE – The San Jose Police Department announced the arrest of two 18-year-old twin brothers, Anh and Duc Tong for the murder of 22-year-old Richard Phan of East San Jose. This marked the fourth homicide of the year with the two brothers appearing in the San Jose Superior Hall of Justice on Feb 5, 2014 to face Felony Murder and Accessory to Murder charges.
One brother, Anh Tong is facing Felony Murder charges under PC 187, with a weapon enhancement charge of using a knife, under PC 12022.53. With murder charges against him dropped, Duc Tong now faces two counts under PC 32 – accessory to murder after the fact.
Authorities reported that, on January 26, 2014 at approximately 1:24 A.M., the San Jose Police Department’s 9-1-1 communications center received a report of a person stabbed.
San Jose Police Officer Albert Morales said, “Preliminary investigation into the murder revealed that the victim was at the home of a friend celebrating a birthday on Suncrest Avenue”. It is believed that Phan tried to break up a fight near his Piedmont Hills home, when one of the twin brothers turned on him and stabbed him at least once.
On January 27 the San Jose Police Department’s METRO and Gang Suppression Units located and arrested and booked both twin brothers Anh and Duc Tong of San Jose for the stabbing death of Richard Phan. Duc was originally charged with murder, but further investigation convinced the District Attorney to shift the charges to the other twin.

The stabbing occurred at Caesar Chavez Park in Downtown San Jose
It appears the killing may have occurred over a heated argument near a senior residential center located just a few feet from the Fairmont Hotel and Caesar Chavez Park on the 100 block of South Market Street in San Jose.
San Jose Police Sgt. Heather Randol said “Officers responded to a report of a stabbing in Cesar Chavez Park, located in the 100 block of South Market Street, at about 12:20 a.m. When officers arrived at the park, they found a male suffering from at least one stab wound.”
Officers arrived at the scene to find a male in his early 30’s suffering from multiple stab wounds. He was later taken to the Regional Medical Center where he was pronounced dead. The reason into the stabbing is not known. Police are reviewing surveillance footage from the area in hopes of identifying the suspect(s) responsible for the stabbing.
